Data Processing Agreement- Schedule A Details of Personal Data Processing

A. List of Parties

  Activities relevant to the transfer: Partner provides the Partner Services to Customer and, as a result, Processes Customer Personal Data as described in the Marketplace Order Form and this DPA.
  Signature and date: The Parties agree that Customer’s execution of the Marketplace Order Form and Partner’s execution of the Marketplace Partner Agreement shall constitute execution of the Standard Contractual Clauses, if applicable.
  Role: Controller or Processor as described in Section 2 of the DPA.

  Activities relevant to the transfer: Partner provides the Partner Services to Customer and, as a result, Processes Customer Personal Data as described in the Schedule 1, Section A of this Marketplace Partner Agreement and DPA.
  Signature and date: The Parties agree that Customer’s execution of the Marketplace Order Form and Partner’s execution of the Marketplace Partner Agreement shall constitute execution of the Standard Contractual Clauses, if applicable

B. Description of Transfer

Categories of Individuals: The categories of Individuals are determined and controlled by Customer.

Categories of Personal Data: ATS shall process and retain customer contact data furnished by Swoogo and the end client. The storage of this data will be conducted utilizing our existing Customer Relationship Management {CRM) system, Zoho. Such data shall be employed solely for the purpose of communicating with the client concerning their forthcoming event(s). ATS undertakes to expeditiously erase said data upon receiving a formal request for deletion. The aforementioned data encompasses, but is not confined to, details such as first and last names, titles, affiliations with companies or associations, phone numbers, email addresses, and physical addresses. It is imperative to note that ATS does not retain any records of the IP-addresses utilized by clients for communication with our platform.

Sensitive Personal Data transferred: Customer is prohibited from providing Sensitive Data for Processing under the Marketplace Order Form. Partner does not want to, nor does it intentionally, collect or Process any Sensitive Data in connection with the Partner Services.

The frequency of transfer: Continuous and as determined by Customer’s use of the Partner Services.

Nature of the Processing: Partner will collect, receive, store, retain, transmit, delete (as provided in the DPA), use, and otherwise Process Customer Personal Data as needed to provide the Partner Services. American Tradeshow Services will receive data, process data to print attendee badges, track attendance in event, store data for up to 6 years then delete unless otherwise instructed by customer. American Tradeshow Services stores this data for the sole purpose of the client having access historical event information, and no other purpose. I.e. badging, lead retrieval, session tracking reports.

Purpose of the Processing: The purpose of the Processing is to facilitate Partner’s provision of the Partner Services to Customer in accordance with the Marketplace Order Form this DPA, and applicable Law. Partner provides on-site registration, badging, attendance tracking, lead retrieval, as described in
Schedule 1, Section A of this Marketplace Partner Agreement.

Period for which the Personal Data will be retained: Partner will Process Customer Personal Data for as long as required to provide the Partner Services, and as described in Section 14 (Deletion or Return of Custom-er Personal Data) of this DPA.

Sub-processors: Same as above.

C. Competent Supervisory Authority

The Customer’s competent supervisory authority will be determined by Customer in accordance with Data Protection Laws.
